conventio vincit legem

Agreement takes the place of the law: the express understanding of parties supersedes such understanding of parties supersedes such understanding as the law would imply. Parties are permitted to make law for themselves where their agreements do not violate the express provisions of any municipal law nor injuriously affect the interests of the public.
